Politique de Confidentialité de Mood SMS

Notre politique de confidentialité a été mise à jour le 25 avril 2023.

Introduction

La présente politique de confidentialité décrit Nos politiques et procédures en matière de collecte, de l’utilisation et de la divulgation de vos informations si vous utilisez nos services d’application, si vous utilisez un service d’application ou une Application avec nos services intégrés. La Politique vous informe de vos droits en matière de confidentialité et de la manière dont la loi Vous protège. 

Nous utilisons Vos données pour fournir et améliorer les Services. Lorsque vous installez, exécutez et utilisez les applications Appvestor et la technologie d’identification de l’appelant (CallerID), vous acceptez la collecte et l’utilisation des informations conformément à la présente politique de confidentialité.  

Les services d’Appvestor ne sont pas destinés à ou conçus pour des personnes de moins de 18 ans.

Interprétations et définitions

Interprétation

Sauf indication contraire du contexte, les termes suivants ont la signification suivante, et ils ont la même signification, qu’ils apparaissent au singulier ou au pluriel.

Définitions

Au sujet de la présente politique de confidentialité :

  • “Entreprise”, au sujet de la CCPA (California Consumer Privacy Act), désigne la Société en tant qu’entité juridique qui collecte les informations personnelles des Consommateurs et détermine les objectifs et les moyens du traitement de ces informations. Le type d’informations collectées détermine les objectifs et les moyens du traitement, seul ou en collaboration avec d’autres parties.
  • “Société” (désignée par “la société”, “nous”, “notre” ou “nos” dans le présent accord) fait référence à :

  • “Service(s)” désigne l’une des applications Appvestor et/ou la technologie d’identification de l’appelant (CallerID).
  • “Partenaire de données” désigne toute personne physique ou morale à laquelle sont transférées des données permettant au partenaire de données de – via les services d’Appvestor – fournir de la publicité à l’utilisateur final (également définis comme des partenaires commerciaux conformément à la CCPA, voir ci-dessus).
  • “Données d’utilisation” désigne les données collectées automatiquement, soit générées par l’utilisation du service, soit par l’infrastructure du service elle-même.
  • “Vous” désigne l’individu qui accède ou utilise le Service, ou la société, ou toute autre entité juridique pour le compte de laquelle cet individu accède ou utilise les Services, selon le cas. Vous pouvez être désigné comme la Personne concernée ou comme l’Utilisateur car vous êtes la personne qui utilise le Service.

Collecte et traitement des données

Types de données collectées

Informations Techniques

Lors de l’utilisation de notre service, nous pouvons vous demander de nous fournir certaines informations techniques nécessaires. Les informations techniques peuvent inclure, mais ne sont pas limitées à : L’adresse IP, Votre pays, les Données d’utilisation, la langue de l’appareil, la vitesse Internet de l’appareil et le numéro d’information de Votre appareil afin que les Services puissent Vous être fournis. Ces informations collectées sont nécessaires à Appvestor pour vérifier que Votre appareil est correctement enregistré.

Autres données

Appvestor accède et traite les numéros de téléphone, la durée des appels entrants et sortants et les listes de contacts avec Votre consentement explicite, afin de pouvoir Vous fournir Notre service d’identification de l’appelant (CallerID). Appvestor accède également à l’identifiant publicitaire (ID de l’annonceur, AdvertiserID) lié à l’application installée, l’utilise, et peut accéder à la documentation sur Votre consentement dans les paramètres de Votre compte Google concernant les publicités personnalisées et l’utiliser. La documentation sur ce consentement ne comprend qu’un identifiant unique, qui est généré lorsque Vous installez l’application mobile et faites Votre choix.

En outre, lorsque Vous utilisez Notre Service, Nos Partenaires de Données peuvent, uniquement avec Votre consentement explicite, collecter certaines données relatives à l’appareil et à la localisation (localisation approximative et précise) afin de pouvoir offrir une gamme de services qui incluent, mais ne sont pas limités à, une expérience publicitaire plus personnalisée, et une amélioration de la fonctionnalité de l’application et de l’expérience utilisateur par le biais d’analyses. Vous pouvez retirer votre consentement à tout moment.

Pour les utilisateurs finaux d’une application dans laquelle Nos Services sont intégrés

Si vous avez installé une application sur votre appareil qui intègre notre service, nous pouvons demander à votre fournisseur d’applications de nous donner accès à certaines informations techniques nécessaires. Les informations techniques peuvent inclure, sans s’y limiter : le numéro d’information de l’appareil de Votre appareil afin que les Services puissent Vous être fournis. Ces informations collectées sont nécessaires à Appvestor pour vérifier que l’appareil de l’Utilisateur (= Vous) est enregistré avec précision. .

De même, Appvestor accède et utilise également l’ID de l’annonceur (AdvertiserID) et la documentation sur Votre consentement dans les paramètres de Votre Compte Google concernant les publicités personnalisées. La documentation sur Votre consentement ne comprend qu’un ID unique, qui est généré lorsque Vous installez l’application mobile et faites Votre choix concernant les annonces. Appvestor ne peut pas retracer les ID des annonceurs ou l’ID unique lié à un consentement jusqu’à l’identité d’un utilisateur spécifique.

Utilisation de vos Données

Appvestor s’engage à respecter les termes de la politique du Programme Développeur du Google Play et se réserve le droit d’utiliser les données anonymes pour les statistiques et l’assistance aux utilisateurs sans restrictions concernant l’applicabilité dans le temps.

Appvestor peut utiliser Vos Données aux fins suivantes :

  • Gérer vos demandes, y compris le suivi de l’utilisation de notre service dans le but d’améliorer les fonctionnalités techniques.
  • Pour vous contacter : Pour vous contacter par le biais de communications électroniques, telles que des notifications push.
  • Gérer vos demandes : Pour répondre et gérer une demande de votre part concernant la suppression de l’application et de toutes vos données personnelles.Pour répondre et gérer une demande de votre part concernant la suppression de l’application et de toutes vos données personnelles.

Nous pouvons partager vos données dans les situations suivantes :

  • Avec des partenaires commerciaux (partenaires de données) : Nous pouvons – avec Votre consentement – partager Vos informations avec Nos partenaires commerciaux. Nos partenaires commerciaux peuvent fusionner les éléments de données collectés pour Vous offrir certains services lorsque Vous cliquez sur des publicités diffusées via Nos Services, conformément aux objectifs déclarés dans leurs politiques de confidentialité respectives.

Conservation de vos données

Appvestor traitera et conservera les Données d’utilisation anonymisées à des fins d’analyse. Les Données d’utilisation sont généralement conservées pendant une période plus courte, sauf si ces données sont utilisées pour renforcer la sécurité ou améliorer la fonctionnalité de Notre Service, ou si Nous sommes légalement obligés de conserver ces données pendant des périodes plus longues.

Base juridique du traitement de vos données

Appvestor traite les données à caractère personnel pour poursuivre Notre intérêt légitime à gérer Notre activité – y compris être en mesure de traiter les contrats et les achats de divers produits et licences pour Notre activité et améliorer, développer et commercialiser Nos Services, et se conformer à Nos obligations légales. La base juridique de Notre traitement est donc les articles suivants du règlement général sur la protection des données :

  • Article 6 (1), litra a, selon lequel les données à caractère personnel peuvent être traitées avec un consentement explicite.
  • Article 6 (1), litra b, selon lequel les données à caractère personnel peuvent être traitées si cela est nécessaire à l’exécution d’un contrat.

  • Article 6 (1), litra f, selon lequel les données à caractère personnel peuvent être traitées si cela est nécessaire à la poursuite d’un intérêt légitime, à moins que les intérêts de la personne concernée ne prévalent.

Note: Parce que Nous traitons Vos données en partie sur la base de l’article 6 (1) litra f, (intérêts légitimes) Vous pouvez dans certains cas vous opposer à Notre traitement autrement licite de Vos données personnelles si Vous constatez que Vos intérêts à ne pas voir Vos données traitées dépassent Nos intérêts légitimes à traiter Vos données, cf. article 21 dans le règlement général sur la protection des données. Transfert de vos Données

Vos données personnelles (l’identifiant de l’annonceur AdvertiserID et l’identifiant unique, Caller ID, concernant le consentement), peuvent être traitées dans tout endroit où Nos Partenaires de données sont situés. Cela signifie que ces informations peuvent être transférées vers – et conservées sur – des serveurs situés en dehors de Votre État, province, pays ou autre juridiction gouvernementale où les lois de protection des données peuvent différer de celles de Votre juridiction.

Si Vos données sont transférées vers un pays situé en dehors de l’UE/EEE, et si le pays en question n’a pas été approuvé par la Commission européenne comme offrant une protection adéquate (Voir la liste des décisions d’adéquation ici) Nos transferts de données seront basés sur des Clauses Contractuelles Standard (CCS) également approuvées par la Commission européenne.

En outre, Appvestor prendra toutes les mesures raisonnablement nécessaires pour s’assurer que Vos données sont traitées en toute sécurité et conformément à la présente politique de confidentialité et aucun transfert de Vos données personnelles n’aura lieu vers une organisation ou un pays à moins qu’il n’y ait des contrôles adéquats en place, y compris la sécurité de Vos données et autres informations personnelles.

Nous avons conclu des accords avec les Partenaires de données suivants. Ces fournisseurs tiers collectent, stockent, utilisent, traitent et transfèrent des informations concernant Votre activité sur Notre Service conformément à leurs propres Politiques de confidentialité. Tous nos fournisseurs de services se réservent le droit d’utiliser et de fusionner les informations transférées à des fins de statistiques, de personnalisation des annonces dans les applications et autres publicités, et d’assistance aux utilisateurs, sans restriction quant à l’applicabilité dans le temps et conformément à leur politique de confidentialité déclarée.

Nous ne transférerons donc les données qu’avec votre consentement spécifique.

Autre divulgation de vos Données

Application de la loi

Dans certaines circonstances, Appvestor peut être tenue de divulguer Vos Données conformément à la loi ou en réponse à des demandes valables des autorités publiques (par exemple, un tribunal ou un organisme gouvernemental). Si nous décidons de recueillir des catégories supplémentaires d’informations personnelles ou d’utiliser les informations personnelles que nous avons recueillies à des fins matériellement différentes, non liées ou incompatibles, nous mettrons à jour la présente Politique de Confidentialité.

Utilisation des informations personnelles

Nous pouvons utiliser ou divulguer les informations personnelles que Nous collectons à des ” fins professionnelles ” ou à des ” fins commerciales ” (telles que définies par l’ACCP). Les fournisseurs de services avec lesquels nous sommes partenaires peuvent utiliser dans le Service une technologie qui vend des informations personnelles telles que définies par la loi CCPA.   • Le droit de refuser la vente de données personnelles (opt-out). Vous avez le droit de nous demander de ne pas vendre vos informations personnelles. Pour soumettre une demande de retrait, veuillez nous contacter.
  • Le droit de supprimer les données personnelles. Vous avez le droit de demander la suppression de Vos données personnelles, sous réserve de certaines exceptions. Une fois que Nous aurons reçu et confirmé Votre demande, Nous supprimerons (et donnerons instruction à Nos Prestataires de services de supprimer) Vos données personnelles de Nos dossiers, sauf exception. Nous pouvons refuser Votre demande de suppression si la conservation des informations est jugée nécessaire pour Nous ou Nos Prestataires de services.
  • Le droit de ne pas être victime de discrimination. Vous avez le droit de ne pas être discriminé pour avoir exercé l’un de vos droits de consommateur.

Nos services ne s’adressent pas aux personnes âgées de moins de 18 ans.

Introduction

This Privacy Policy describes Our policies and procedures on the collection, use, and disclosure of Your information if You use Our Application Mood SMS. The Policy tells You about Your privacy rights and how the law protects You. 

We use Your data to provide and improve the Services. When installing, running, and using Mood SMS and Caller ID technology, You agree to the collection and use of information in accordance with this Privacy Policy. 

Mood SMS is not intended for or designed to attract anyone under the age of 18.

Unless otherwise stated in the context, the following terms have the following meanings, and they shall have the same meaning regardless of whether they appear in singular or in plural.

  • “Business”, for the purpose of the CCPA (California Consumer Privacy Act), refers to the Company as the legal entity that collects Consumers’ personal information and determines the purposes and means of the processing of this information. The type of information collected determines the purposes and means of the processing, either on its own or in conjunction with other parties.
  • “Company” (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to:

  • “Device” means any device that can access the Service.
  • “Data” is any information that relates to a User of any of Our Services.
  • “Sale”, for the purpose of the CCPA (California Consumer Privacy Act), means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer’s personal information to another business or a third party for monetary or other valuable consideration.
  • “Service” refers to Mood SMS and/or Caller ID technology.
  • “Data Partner” means any natural or legal person to whom data is transferred making it possible for the Data Partner to – via Appvestor’s Services – provide advertising to the end-user (also defined as Business Partners in accordance with CCPA, see above).
  • “Usage Data” refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.
  • “You” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Services, as applicable. You can be referred to as the Data Subject or as the User as You are the individual using the Service.

Technical Information

While using Our Service We may ask You to provide Us with some necessary technical information. Technical information may include, but is not limited to: IP-address, Your country, Usage Data, device language, device internet speed, and device information number from Your device so that the Services can be provided to You. End User License Agreement

Preamble

This End User License Agreement (“Agreement“) governs your use of the Caller Identification Service (“Service“) owned and operated by Appvestor ApS, Danish company registration number DK37614904 business address: Gladsaxevej 342, 2860 Soeborg, Denmark (”Appvestor“, ”we“ or ”us“).

Service Description

Our Service provides you with free Caller Identification during phone calls and/or after you have made or received a phone call. As part of the Service we serve advertisements (“Advertisement“) on Caller Identification screens.

Our Service may be included in certain third-party applications (“Application“) that you have installed. You will be notified if an Application includes our Service, so that you can decide whether to use the service or not. You can at any time adjust your Caller Identification preferences and enable or disable the Service in the settings. You can access the settings from every Caller Identification screen.

By using the Service you expressly state that you fully accept the terms and conditions of this Agreement and any other terms and conditions which are incorporated herein by reference. If you do not fully accept the terms and conditions of this Agreement, you cannot use our Service.

License

Appvestor gives you the non-exclusive and not transferable right to access and to use the Service in connection with installing the Application.

You may only use the Service for your personal use. The access to the Service as well as the use of the Service will only be given on the basis and after the unconditional acceptance of the terms and conditions of this Agreement and any other terms and conditions which are incorporated herein by reference. Other rights regarding the Service on whatever legal basis are not granted.

You are not entitled (i) to use the Service for commercial purposes or (ii) to grant, transfer, sell, lend or make available in any manner any rights regarding the Service to third parties. Granting sublicenses is also not allowed. You are not entitled to store or install a copy of the Service.

Proprietary Rights

You herewith confirm that you are aware that Appvestor is the exclusive owner of the Service as well as of all and any rights connected thereto, especially property rights and copyrights.

Collection of Information

In order to provide you with the Service, we may access your mobile device and gather certain information. To see what information you share with Appvestor and how this information may be used by Appvestor, please see Appvestor’s Privacy Policy.

If you do not wish to use the Caller Identification Service, or if you do not want to receive Advertisements from Appvestor, or if you want to disable Appvestor’s access to your device, you can terminate the Service by disabling it in the settings of the Service at any time. You can access the settings from every Caller Identification screen.

Advertisement

The Advertising displayed on the Caller Identification screens complies with Google’s guidelines for content rating and reflects the maturity rating of the Application in which our Service is included. Appvestor excludes sensitive categories including but not limited to advertisements containing gambling or sexually explicit content, violence and bullying, or “hate speeches” via the Service. Appvestor does not have full control over advertisements and makes no representation or warranties of any kind regarding the content of the advertisements. Appvestor is not liable in any manner or any case for advertisements. Even in case of errors or by accident, Appvestor is not liable for advertisements even if regarding sensitive content.

Scope of Liability and Warranty, Indemnification

Appvestor shall not be liable for damage unless it was caused by Appvestor or its representatives with willful or gross negligence. Any liability for personal injuries shall remain unaffected thereby. Any liability for third-party damages, consequential damages, and loss of profits shall be excluded. Appvestor shall not be liable for the content of the data transmitted and the content of data that may be accessed via the Service.

Appvestor will also not be liable in any way for network-related problems.

Appvestor operates the Service with the utmost care, reliability, and availability. However, Appvestor does not warrant that the Service will be available without interruption, that the desired connections can be established at all times or that the information transmitted is always correct, accurate, and complete.

Appvestor makes no representation that the Service is available to you in any particular location. You are obliged to comply with all legal or contractual obligations and shall hold Appvestor harmless in this regard.

You agree to indemnify, hold harmless and defend Appvestor and all related persons, entities, agents, etc. from and against any action, claim, demand, dispute, or liability arising from or relating to any negligence or willful misconduct of you or related persons, entities, agents, etc., your breach of this agreement, any allegation that the application infringes a third party´s copyright or any intellectual property right or any misrepresentation of you.

You confirm, that you agree that Appvestor shall have the unrestricted right to participate in the defense in any of the above-mentioned cases through counsel of his own choice.

Should the restrictions of the warranty and liability of Appvestor be in breach of mandatory statutory provisions, all warranty and liability obligations shall, in terms of scope, be reduced to the statutorily admissible minimum extent.

Termination

You are entitled to terminate this Agreement at any time by disabling the Service in the settings. You can access the Service from every Caller Identification screen.

Appvestor is entitled to terminate your right of usage of the Service at any time without cause with or without advance notice.

The right of usage will automatically end if you violate or fail to comply with the terms and conditions of this Agreement.

Miscellaneous

Appvestor reserves the right to freely assign and transfer the rights and duties under these terms and conditions to any third party.

All amendments and supplements to the license terms shall be made in writing. The same shall apply to any deviation from this requirement of form.

Should any provisions of this agreement be or become ineffective, invalid, or unenforceable, this shall not affect the effectiveness, validity, or enforceability of the remaining provisions. In the case of ineffectiveness, invalidity, or unenforceability of any of these provisions, a provision which is neither ineffective nor invalid or unenforceable and which in its economic result comes closest to the provision to be replaced shall be agreed upon between the parties to this agreement.

The local city court of your local jurisdiction shall have jurisdiction regarding any disputes; applicability of your local law shall be deemed agreed and CISG and the conflict of laws rules of private international law shall be excluded.

Deletion of Your Data

All data that has fulfilled its purposes will be identified by Appvestor and deleted without delay in accordance with this privacy policy. Appvestor will take all commercially and technologically reasonable measures to ensure personal data will practically not be recoverable or reproducible. Data will specifically be deleted depending on how the data was collected, stored, and your interaction with Our Services. Digital documents containing personal data will be deleted via a technical method that will make it reasonably impossible to recover, retrieve, or become re-identifiable. Appvestor does not store personal data on non-digital documents or files.
